These Terms of Service (“Terms”) govern your access to and use of the websites, waitlists, iOS app, and related services (the “Services”) provided by Glitch, a sports technology product operated by Otaku Labs Inc. (“Glitch,” “we,” “us,” or “our”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Eligibility
You must be at least 18 years old and able to form a binding contract to use the Services. You are responsible for complying with the laws that apply to you.
What Glitch is
Glitch is a consumer sports technology app that provides sports feeds, AI-assisted analysis, recommended picks, notifications, and related content. The Services may also include conversational AI features that let you ask questions about sports, teams, games, and the content available in Glitch.
Glitch is not a sportsbook or wagering service. We do not accept or place wagers, execute transactions, hold customer funds, or provide access to gambling accounts. Glitch content is provided for informational and entertainment purposes only.
Sports picks and AI-generated content
Sports picks, rankings, summaries, projections, chat responses, and other analysis may be generated or assisted by automated systems. This content can be incomplete, outdated, or incorrect and should not be treated as a guarantee of any result. Past performance does not predict future results.
You are responsible for independently evaluating Glitch content and for any decisions you make based on it. Glitch does not provide financial, investment, legal, tax, or gambling advice.
Your account and content
You may need to sign in through a third-party authentication provider. You are responsible for activity under your account and for keeping your access credentials secure. Notify us promptly of any unauthorized use.
If you submit prompts, questions, feedback, or other content through the Services, you grant us permission to process that content as needed to provide, maintain, protect, and improve the Services. Do not submit content that is unlawful, infringes another person’s rights, or contains sensitive information you do not want processed by the Services.
Subscriptions and billing
Glitch may offer an auto-renewing subscription billed through Apple in-app purchase. The price, trial period, and billing interval shown in the App Store at the time you subscribe control your purchase. Your subscription renews automatically unless you cancel at least 24 hours before the end of the current billing period. You can manage or cancel your subscription in your Apple ID settings. Apple handles billing, refunds, and cancellations under its terms.
Text messages
If you provide your mobile number and opt in, you consent to receive recurring automated text messages from Glitch about early access and account notifications. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time or HELP for help. SMS consent is optional and is not a condition of purchasing or using Glitch. Acceptable use
You agree not to:
- Use the Services for an unlawful purpose or in violation of these Terms.
- Attempt to disrupt, reverse engineer, or gain unauthorized access to the Services or related systems.
- Misuse, copy, scrape, or resell the Services or use them to build a competing product except as permitted by law.
- Interfere with another user’s use of the Services.
- Use automated output from Glitch to mislead others or represent it as guaranteed, verified, or authored by a human when it is not.
Intellectual property
The Services, including our software, design, content, and trademarks, are owned by us or our licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose.
Third-party services and data
The Services may rely on or link to third-party services, including Apple, authentication providers, sports-data providers, analytics providers, and AI service providers. We do not control and are not responsible for those services, and your use of them may be governed by their own terms. Sports data, schedules, injuries, and other third-party information may be delayed, incomplete, or inaccurate.
Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services or their content will be uninterrupted, error-free, complete, timely, or accurate.
Limitation of liability
To the maximum extent permitted by law, Glitch and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, opportunities, or other losses arising out of or related to your use of the Services or reliance on their content.
Indemnification
You agree to indemnify and hold harmless Glitch and its affiliates from claims, damages, and expenses arising out of your use of the Services or violation of these Terms.
Termination
We may suspend or terminate your access to the Services at any time, with or without notice, including for violation of these Terms.
Dispute resolution and arbitration
Please read this section carefully. It affects your rights.
- Binding arbitration.Any dispute arising out of or relating to these Terms or the Services will be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its rules rather than in court.
- Individual claims only. You and Glitch agree that disputes may be brought only on an individual basis and not as a plaintiff or class member in a class, consolidated, or representative action.
- Small claims. Either party may instead bring an individual claim in small claims court if it qualifies.
- Opt-out. You may opt out of this arbitration agreement by emailing support@tryglitch.com within 30 days of first accepting these Terms, stating your name and that you wish to opt out of arbitration.
Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, except where applicable law requires otherwise.
Changes to these Terms
We may update these Terms from time to time. We will post the updated version here and revise the “Last updated” date above. Your continued use of the Services after changes take effect constitutes acceptance.
